Terms of Service

1. Acceptance of Terms

By accessing or using ContentAgent ("the Service"), operated by Kern ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ContentAgent is an AI-powered content creation tool that generates text based on your inputs. It uses third-party AI models via OpenRouter to produce content, applies quality scoring, and stores your voice profile data to personalize output.

3. Accounts

You must create an account to use the Service. Account authentication is handled by Clerk. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Plans and Billing

The Service offers a free plan (10 generations per month) and a Pro plan ($19/month for 50 generations). Billing is processed through Polar.sh. Plan prices may change with 30 days' notice.

Generation top-ups, if available, are one-time purchases and do not recur. Refunds are handled at our discretion — contact support if you have billing questions.

5. Your Content

You retain ownership of all content you input to the Service (writing samples, briefs, prompts) and all content the Service generates for you. We do not claim ownership of your inputs or outputs.

You grant us a limited license to process your inputs through third-party AI models for the purpose of generating your content. This processing is necessary to provide the Service.

6. Voice Profile Data

When you upload writing samples or answer profile questions, we store this data as your voice profile. This profile is used to personalize content generation. You can delete your voice profile and all associated data by deleting your account.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Impersonate any person or entity without authorization
• Generate content that infringes on others' intellectual property
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service
• Resell or redistribute access to the Service without written permission

8. AI-Generated Content Disclaimer

Content generated by the Service is produced by AI models and may contain inaccuracies, biases, or errors. You are responsible for reviewing, editing, and verifying all generated content before publishing. We make no guarantees about the accuracy, completeness, or suitability of generated content for any purpose.

9. Service Availability

We strive to maintain continuous availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service or any part of it at any time with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, Kern shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive will remain in effect.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
